Abstract Land transaction has been resulting many big problems. One of the reasons is that the regulation on transaction cost is limited in the level of Regency. Various expenses fulfilling the regional requirement have not been regulated. This raises chances of illegal expenses which tend to make burden on the society. This research is aimed at finding out factors that cause the illegal expenses in land transaction. This research is done by interviewing several respondents and some life resources, and by observing the process of land transaction. The result shows that the illegal expenses practices still exist and it is difficult to take it out. Among dominant causes is the imperfect law on land transaction expenses. This imperfection is utilized by the involved to take advantages for their own interest. The chief of villages utilized the imperfect law by creating the Village Regulation and the executors take advantages over it by giving hostile services for those who are un willing to pay the illegal expense.
