| الملخص: | In human life, role of land is very important. Beside as a residence, land is
also an object in an agreement. The more numbers of residents, the less amounts of
land width which indicates that between requirement of land and the amount of land
width is not balance. Therefore there will be immeasurable agreements, one of them
is an agreement of Agriculture Sharing Holder. The execution of the agreement of
Farmland Sharing Holder is conducted at rural public because of the majority of
residence occupation as a farmer, so does the execution of agreement of Farmland
Sharing Holder in Sub district of Wonosari, Regency of Klaten.
The goal of this research is to know the implementation of the written rule
and the balance of yield distribution on the execution of Agreement of Farmland
Sharing Holder in Sub distric of Wonosari Regency of Klaten, and to know the
factors that become obstacles for the implementation of the written rule and the
balance of yield distribution rule according to Laws of No. 2 Year 1960 about
Agreement of Farmland Sharing Holder.
The research method is applied using the method of empiric and normative
approach. The collected data are primary data by field research and the secondary
data by literatures. The data afterward is analyzed in qualitative manner to answer the
questions in this research.
From the result of this research, the conclusion is gained that the form of
Agreement of Farmland Sharing Holder in Sub distric of Wonosari Regency of
Klaten is not done in a written form according to the commandment of Laws of No. 2
Year 1960 about Agreement of Farmland Sharing Holder, but rather based on local
custom that has going on hereditary that the agreement based on the accordance and
common ground between the owner of farmland and the smallholder. The act of
determining of the balance of yield distribution that prevails in Sub distric of
Wonosari Regency of Klaten is not determined based on the decree of the Regent that
regulate about the balance of the distribution of yield on an Agreement of Farmland
Sharing Holder but rather based on the distribution that is accepted in local custom.
There are few factors that become obstacles within the implementation of
Laws of No. 2 Year 1960 about Agreement of Farmland Sharing Holder, and the law
instruments that did not make serious efforts to socialize it and maintain the
implementation of Laws of No. 2 Year 1960 about Agreement of Farmland Sharing
Holder. Another factor comes from the people that are not ready to accept the
contents of above mentioned ordinance along with the culture of the community that
has the contradiction with the contens of Laws of No. 2 Year 1960 about Agreement
of Farmland Sharing Holder. |
