These two mainstreams of thought begin to appear during the Constitution Formation and remain through the time of the Constitution Formulation and Constitution Adoption. However, these two mainstreams of thought are able to make compromise at certain level resulting in the adoption of the semi-democratic principles and embodied in the 1978 and 1991 Constitutions. This is because the oligarchic political forces (who were the political elites at that time), have realized the importance of the democratic mainstream of thought, as championed by the democratic political forces who want to share political power, so that the looming political crises can be avoided. วิทยานิพนธ์นี้มีวัตถุประสงค์เพื่อศึกษาเปรียบเทียบการร่างรัฐธรรมนูญ ฉบับปีพุทธศักราช 2521 กับปีพุทธศักราช 2534 โดยเฉพาะอย่างยิ่งในประเด็นสำคัญในขั้นตอนของการก่อตัวของร่างรัฐธรรมนูญ ขั้นตอนของการยกร่างรัฐธรรมนูญและขั้นตอนของการพิจารณาร่างรัฐธรรมนูญ ผลการศึกษาพบว่าในการร่างรัฐธรรมนูญ ฉบับปีพุทธศักราช 2521 และปีพุทธศักราช 2534 มีกระแสความคิดหลักที่ขัดแย้งกันอยู่สองกระแสความคิดคือกระแสความคิดแบบคณาธิปไตยกับกระแสความคิดแบบประชาธิปไตย โดยกระแสความคิดทั้งสองกระแสได้เริ่มก่อตัวขึ้นมาพร้อมๆ กับการก่อตัวของร่างรัฐธรรนูญและยังคงดำรงอยู่อย่างต่อเนื่องเมื่อมีการยกร่างรัฐธรรมนูญและมีการพิจารณาร่างรัฐธรรมนูญทั้ง 2 ฉบับ อย่างไรก็ตามกระแสความคิดทั้งสองกระแสดังกล่าวก็สามารถที่จะประนีประนอมกันได้ในระดับหนึ่งเนื่องจากได้มีการยอมรับหลักการที่มีลักษณะกึ่งประชาธิปไตย ดังที่มีปรากฎอยู่ในบทบัญญัติหลายมาตราของรัฐธรรมนูญทั้ง 2 ฉบับทั้งนี้เนื่องจากกระแสความคิดแบบคณาธิปไตยซึ่งมีกลุ่มพลังทางการเมืองฝ่ายคณาธิปไตยเป็นตัวแทน (และเป็นกลุ่มชนชั้นนำทางการเมืองที่มีอำนาจทางการเมืองอยู่ในขณะนั้น) ได้เริ่มตระหนักถึงความสำคัญของการมีส่วนร่วมในการใช้อำนาจทางการเมืองของกระแสความคิดแบบประชาธิปไตยซึ่งมีกลุ่มพลังทางการเมืองฝ่ายประชาธิปไตยเป็นตัวแทน เพื่อเป็นการหลีกเลี่ยงวิกฤตการณ์ทางการเมืองที่อาจจะเกิดขึ้นมาเมื่อใดก็ได้ Public policy (Law) -- Thailand Constitution of the Kingdom of Thailand B.E. 2521 Constitution of the Kingdom of Thailand B.E. 2534 Oligarchy Democracy Political leadership -- Thailand Constitutions -- Thailandรัฐธรรมนูญเปรียบเทียบ นโยบายสาธารณะ (กฎหมาย) -- ไทย รัฐธรรมนูญแห่งราชอาณาจักรไทย พ.ศ. 2521 รัฐธรรมนูญแห่งราชอาณาจักรไทย พ.ศ. 2534 คณาธิปไตย ประชาธิปไตย ผู้นำทางการเมือง -- ไทย รัฐธรรมนูญ -- ไทย กระมล ทองธรรมชาติ https://digiverse.chula.ac.th/digital/file_upload/biblio/cover/62861.jpg |
