Different projects have different subcontract details and may cause problems and disputes. The objectives of this research are to study problems of subcontracts in construction projects and suggest guidelines of subcontract improvement for Thai construction projects. The research methods are 1) Collecting problematic and disputable issues in subcontracts causing difficulty in managing construction projects 2) Conducting interviews of the issues in subcontracts affecting the project progress from the relevant parties: both main contractors and subcontractors 3) Analyzing the issues’ frequency, severity, importance and correlation. From the research, thirty one issues are raised and analyzed to identify the number of issues that are covered in the AIA A401-2007 standard subcontracts. It was found that twenty one issues are covered by the AIA A401-2007 standard subcontracts, and other ten issues are not. Moreover, it was discovered that eleven issues very important in need of improvement. Within these eleven issues, eight issues have already been covered by the AIA A401-2007 standard subcontract since the definitions and solutions are clear. The rest three issues are beyond of the AIA A401-2007 standard subcontracts’ scope, but they can apply the international standard contract FIDIC 1999 and the example contract attached to the Prime Minister’s Office Regulations (regarding procurement) to relieve the conflicts. Three main issues from the eleven issues are 1) Details of subcontracts – insufficiency of details 2) Change of the work in the projects 3) Delays of subcontracts beyond the main schedule. การจัดทำสัญญาจ้างช่วงในโครงการก่อสร้างระหว่างผู้รับเหมาหลัก และผู้รับเหมาช่วงในประเทศไทย ยังไม่มีการกำหนดเป็นลักษณะของสัญญามาตรฐาน ดังนั้นรายละเอียดของสัญญาจ้างช่วงจึงมีความแตกต่างกันในแต่ละโครงการ และอาจทำให้เกิดปัญหา และข้อขัดแย้งในการทำสัญญาได้ ดังนั้นการวิจัยนี้จึงมีวัตถุประสงค์เพื่อศึกษาถึงปัญหาของสัญญาจ้างช่วงในงานก่อสร้าง และเสนอแนวทางการปรับปรุงสัญญาจ้างช่วง โดยจำกัดขอบเขตอยู่เฉพาะงานอาคารในประเทศไทย ขั้นตอนงานวิจัยนี้เริ่มต้นด้วย 1)การรวบรวมปัญหา และข้อโต้แย้งที่มีผลต่อการจัดการสัญญาจ้างช่วงในงานก่อสร้าง 2)ใช้วิธีการสัมภาษณ์ความคิดเห็นเกี่ยวกับปัญหาสัญญาจ้างช่วงในงานก่อสร้างจากผู้ที่เกี่ยวข้อง และมีประสบการณ์ในการจัดการงานก่อสร้าง โดยทำการสัมภาษณ์ 2 ฝ่ายคือ ฝ่ายผู้รับเหมาหลัก และฝ่ายผู้รับเหมาช่วง 3)วิเคราะห์ความถี่ ความรุนแรง ความสำคัญ และความสอดคล้องของปัญหา จากผลการศึกษาพบปัญหา 31 ประเด็น จากนั้นทำการวิเคราะห์ความครอบคลุมของปัญหาโดยใช้สัญญาจ้างช่วงมาตรฐานของ AIAA401-2007 โดยพบว่าสัญญามาตรฐานสามารถครอบคลุมปัญหารวม 21 ประเด็น และไม่ครอบคลุมรวม 10 ประเด็น และจากการวิเคราะห์ปัญหาพบว่ามีปัญหาที่มีความสำคัญระดับสูงสำหรับใช้เพื่อทำการวิเคราะห์หาแนวทางการปรับปรุงสัญญาจ้างช่วงมีทั้งสิ้น 11 ประเด็น จากผลการศึกษาปัญหาที่มีความสำคัญในระดับสูงพบว่าปัญหา 8 ประเด็นครอบคลุมโดยสัญญาจ้างช่วงมาตรฐาน โดยปัญหาที่เกิดขึ้นส่วนใหญ่สามารถนำข้อกำหนดของสัญญาจ้างช่วงมาตรฐานมาทำการประยุกต์ใช้ได้เนื่องจากมีข้อกำหนด และหลักปฏิบัติที่ชัดเจน และปัญหา 3 ประเด็นไม่ครอบคลุมโดยสัญญาจ้างช่วงมาตรฐานสามารถใช้ข้อกำหนดของสัญญาจ้างนานาชาติ FIDIC (1999) และสัญญาจ้างตามสัญญาจ้างแนบท้ายระเบียบสำนักนายกฯมาทำการประยุกต์ใช้เพื่อลดข้อขัดแย้งที่เกิดจากปัญหานั้นได้ ปัญหาสามอันดับแรกจากปัญหาสำคัญทั้ง 11 ประเด็น คือ 1)ปัญหาแบบรายละเอียด และข้อกำหนดของสัญญาก่อสร้างในสัญญาไม่มีความละเอียดเพียงพอ 2)การเปลี่ยนแปลงงานโดยมีงานลด งานเพิ่มในระหว่างการก่อสร้าง 3)ปัญหาผู้รับเหมาช่วงปฏิบัติงานล่าช้าเกินกว่าแผนงานหลัก สัญญา อุตสาหกรรมการก่อสร้าง Contracts Construction industry วิสุทธิ์ ช่อวิเชียร https://digiverse.chula.ac.th/digital/file_upload/biblio/cover/43035.jpg |
